What we actually do differently
Every injury firm says it fights hard. Read the complaints injured people leave about this profession and you will almost never find someone saying their lawyer was insufficiently aggressive. You will find, over and over, that nobody called them back.
One client reports a single letter in four years. Another, three different paralegals and no contact unless they initiated it. Another, five years and a dozen witnesses and still nothing. The failure is communication, not advocacy — and it is the thing we have built this practice around.
- You will know who is handling your case and you will be able to reach them.
- You will be told what happens next and roughly when, including when the honest answer is that nothing happens for three months while you finish treatment.
- You will hear the bad news early. If the available insurance will not cover your losses, or liability is a real problem, you will be told at the start rather than at the end.
- We will tell you if you do not need us. A small claim with clear liability and a full recovery may be better handled yourself, and we will explain how.
How we approach a case
Simon Budhwani spent years defending insurance companies and their insureds before building a plaintiff practice. That matters less as a credential than as a method: the work of valuing a claim is largely the work of predicting how the other side will attack it, and that is a learnable skill that comes from having been on the other side of the file.
Find the coverage first
Before anything else, we establish what insurance actually exists — every layer, every potentially responsible party, every umbrella policy that was not volunteered. In a serious case this is frequently worth more than every other decision in the file.
Preserve what is about to disappear
Camera footage, vehicle data, commercial records. Most of it is gone within weeks of nobody asking for it.
Let the medicine lead
No claim is presented while someone is still actively treating, because nobody yet knows what the injury is. The pace of a case is the pace of a recovery.
Build it as if it will be tried
Not because most cases are tried — they are not — but because a file built that way settles on different terms than one assembled in a hurry at the end.
What we do not do
We do not publish testimonials, case results, settlement figures, awards or review counts on this site. Not because we have nothing to point to, but because none of it can be verified by you from the outside, and because California regulates how each of those must be described. An award named without the granting body, the year and the selection method tells you nothing.
We also will not tell you what your case is worth on a first phone call, and neither can anyone else honestly. What we can tell you is what your claim consists of, what will be disputed, and what the next two years are likely to look like.
