What this number is and is not
- Gross, not net. Lost earnings are claimed before tax, because that is what you lost.
- Paid leave counts. Sick days and vacation you were forced to spend were earned and have value.
- This is past loss only. It does not touch lost earning capacity — the reduction in what you can earn going forward — which in a serious injury is frequently much larger. See lost wages and earning capacity.
- It needs proof. An employer letter, payslips and tax returns for an employee; tax returns, profit and loss statements and written evidence of work turned down if you are self-employed.
