Why this tool exists
Every competitor in this market offers a settlement calculator that outputs a dollar figure. We will not build one — California prohibits lawyers from predicting outcomes, and a number on a screen is a prediction. A deadline, by contrast, is a fact, and it is the thing that actually ends claims.
The rules it applies
- Two years from the date of injury for most personal injury and wrongful death claims — Code Civ. Proc. § 335.1.
- Six months to present a written administrative claim if a public entity is involved — Gov. Code § 911.2. This is the deadline that ends more good claims than any other rule in California.
- One year to apply for leave to present a late government claim — Gov. Code § 911.4, on grounds including mistake, excusable neglect, minority or incapacity (§ 911.6).
- Six months from a written rejection of a government claim to file suit — Gov. Code § 945.6.
- Tolling until 18 for a minor's claim — Code Civ. Proc. § 352(a) — which does not extend the six-month government deadline.
