Knee injuries

The knee takes the impact in a surprising share of collisions and nearly every significant fall. What makes these claims valuable is rarely the surgery itself — it is what the joint does over the following twenty years.

The mechanisms

  • Dashboard knee. In a frontal impact the knee strikes the dashboard and the force drives the tibia backwards, injuring the posterior cruciate ligament and often the patella. A well-recognized pattern with a specific signature.
  • Twisting with a planted foot — the ACL mechanism, common in falls and in pedestrian impacts.
  • Direct lateral blow, injuring the MCL and frequently producing the unhappy triad of ACL, MCL and medial meniscus.
  • Landing from height, driving the tibial plateau into the femur — a fracture pattern, not just a ligament injury.

Why meniscus tears are argued about

Degenerative meniscal tears are extremely common in middle-aged and older adults without symptoms, so expect the familiar argument. Radiologists can often distinguish features suggesting an acute tear from chronic degenerative change, and the clinical picture of a knee that locked, gave way or swelled within hours of a specific event is powerful.

Swelling timing is worth noting precisely. A knee that swells within a couple of hours suggests bleeding into the joint, which points to a significant structural injury rather than wear.

The twenty-year cost

This is the part routinely missed in settlement. Significant knee injuries — particularly ACL ruptures, meniscal loss and tibial plateau fractures — are associated in the orthopedic literature with substantially elevated rates of post-traumatic osteoarthritis over the following one to two decades.

For a claimant in their thirties that can mean a knee replacement in their fifties, with a revision later, because prostheses do not last forever. A claim settled on the arthroscopy bill and three months of physiotherapy has left the two most expensive events out.

Making that part of the claim requires a treating surgeon or an orthopedic expert to state the long-term risk for this specific person's injury. It will not be inferred by anyone on the other side.

Questions people ask

My knee was sore but I could still walk. Does that mean it is minor?

Not necessarily. People walk on torn ACLs and torn menisci, sometimes for weeks. Giving way, locking, catching, or swelling that came on within hours are all reasons to be imaged rather than to wait and see.

Should my claim account for a knee replacement I have not had?

If a qualified surgeon says it is likely for an injury like yours, yes. Future medical costs are recoverable where they are reasonably certain, and significant knee injuries carry a well-documented long-term arthritis risk. It needs a medical opinion in the record, not an assumption.
