Mission Viejo injury lawyer
South Orange County looks like the safest place to drive in the county, and by most measures it is. The injuries we see from Mission Viejo are shaped by two things instead: the 5 corridor, and an older population for whom a fall is a different event than it is at thirty.

Policing here is the Sheriff, not a city department
Mission Viejo contracts its police services to the Orange County Sheriff's Department. It is a small administrative point with a practical consequence: the collision report is requested from the Sheriff rather than from a city police department, and people regularly waste weeks asking the wrong agency.
Freeway collisions on the 5 and the 241 are CHP, through the San Juan Capistrano Area office.
An older population changes the claim
South Orange County skews older than the county as a whole, and that changes both the injuries and the arguments.
- A hip fracture in an older adult is a sentinel event, with documented consequences for independence and life expectancy. It is not an orthopedic inconvenience and should not be valued as one.
- The osteoporosis argument will be made — that the bone was fragile and would have broken anyway. California's eggshell plaintiff rule answers it: a defendant takes the victim as they find them.
- Lost earnings may be nil but lost services are not. A retired person who can no longer drive, garden, cook or maintain their home has a real economic loss in the cost of paying someone else to do it, and it is routinely left out of claims.
- Loss of independence — moving from a home into assisted living because of an injury — is among the most significant harms in this category, and it needs to be articulated rather than assumed.
Medicare and the lien question
Where a Medicare beneficiary is injured, Medicare has a statutory right to be reimbursed from a settlement for what it paid. This is not optional, it must be resolved before funds are distributed, and ignoring it creates problems for everyone involved.
Handled properly it is routine, and the amount is frequently negotiable. Handled badly it delays a settlement for months. See medical liens and your settlement.
Questions people ask
Who do I get the police report from in Mission Viejo?
The Orange County Sheriff's Department, which provides police services to the city under contract — not a Mission Viejo police department, because there is not one. Collisions on the 5 or the 241 are CHP instead.
My mother is 80 and broke her hip in a fall. The insurer says it was her age.
Age and bone density are not a defense. California applies the eggshell plaintiff rule, meaning a defendant takes the victim as they find them. A hip fracture in an older adult is also a far more serious event than it is in a younger person, with well-documented consequences for independence, and should be valued on what it actually did.
She is retired, so there are no lost wages. Does that reduce the claim?
It removes one component and leaves others that are often overlooked: the cost of help with tasks she can no longer do, the care she now needs, and the loss of independence itself. Those are real and recoverable, and they have to be set out rather than assumed.
