Los Angeles County

Los Angeles injury lawyer

Los Angeles has the largest and most procedurally particular civil court system in the state, and it changed recently in a way that still has not reached most law firm websites.

Where a Los Angeles injury case is actually heard now

The practical difference is real. An Independent Calendar department keeps the case from filing to trial with one judge, rather than the hub model where a case was managed in one place and sent elsewhere for trial. It changes how cases are scheduled, how motions are heard, and how realistic a trial date is.

What makes an LA claim different

  • Volume. Los Angeles County civil courts carry an enormous caseload, and filed cases take longer here than in Orange County. That is a reason to build a claim properly before filing rather than file reflexively.
  • The freeways are CHP. A collision on the 405, the 10 or the 110 is reported by the CHP, not the LAPD, and the report is obtained from a different agency entirely.
  • Uninsured driver rates. A substantial share of drivers here carry no insurance. Your own uninsured motorist coverage is often the whole claim.
  • Public entities everywhere. Metro buses, city vehicles, road and sidewalk defects. All of them carry the six-month claim deadline under Gov. Code § 911.2 rather than two years.

Working with an Orange County firm on an LA case

Worth saying plainly: our offices are in Newport Beach and Orange, not downtown. For most of a claim that makes no difference — the work is records, correspondence, negotiation and, where needed, filings and depositions, and almost none of it requires you to be in a room with us.

Where it does matter, we travel, including to your home or to the hospital. If a case is better served by a firm based in a particular courthouse's backyard, we will say so.

Questions people ask

Does my LA personal injury case go to the Spring Street courthouse?

Not any more. The Personal Injury Hub at Spring Street has closed. Since 8 January 2024, personal injury cases filed in the Central District are assigned to Independent Calendar departments at the Stanley Mosk Courthouse at 111 North Hill Street, and cases elsewhere in the county are heard in local district courthouses.

How long do Los Angeles injury cases take?

Longer than in neighboring counties, because of caseload. Claims that settle without a lawsuit are driven mainly by how long treatment takes. Once filed in LA County, expect the litigation itself to add meaningfully more time than the same case would take in Orange County.

I was hit by a Metro bus. Is that different?

Very. A transit agency is a public entity, so a written claim must be presented within six months under Government Code section 911.2 rather than the usual two years. A common carrier also owes passengers a heightened duty of utmost care under Civil Code section 2100.
