Coast Highway and cyclists

Carlsbad Boulevard is part of the main north county coastal cycling route and carries large numbers of riders every day of the year, alongside visitor traffic, on-street parking and drivers looking at the ocean rather than the road.

The recurring claims are unsafe passing, right hooks at junctions, and doorings. California requires three feet of clearance when overtaking a bicycle (Veh. Code § 21760), and opening a door into traffic places the duty squarely on the person opening it (§ 22517). Expect the argument that the cyclist should not have been where they were — the lane positioning rules have exceptions that cover most real riding.

Resorts and visitor premises

Carlsbad's resorts, golf courses and the theme park bring a steady volume of premises claims: falls on wet pool decks and lobby surfaces, parking lot injuries, shuttle collisions, and injuries at attractions.

California's Three Feet for Safety Act, Vehicle Code section 21760, requires at least three feet of clearance when overtaking a cyclist, and where that is not possible the driver must slow and pass only when it is safe. Any camera footage, your ride data and the position of the damage on both vehicles are the evidence that matters.
